In case of discrepancies between these Terms and Conditions and the reseller agreement, the provisions of the reseller agreement shall prevail.

11. Affiliate Program

ERDA may operate an affiliate marketing program under separate terms and conditions.

Participation in the ERDA affiliate program is subject to the acceptance of the applicable affiliate agreement and rules.

Specific conditions regarding commissions, payments, eligibility criteria, and responsibilities of affiliates are governed by the affiliate agreement.

In case of discrepancies between these Terms and Conditions and the affiliate agreement, the provisions of the affiliate agreement shall prevail.

12. Prices and Payment Methods

Promotions are valid while stocks last and within the period communicated by ERDA.

14. ERDA Gift Cards

A gift card represents a payment instrument that can only be used for purchasing products available on the ERDA website.

Each gift card contains a nominal value, a unique code, and a validity period.

Gift cards may be used for products with a value equal to or higher than the amount available on the gift card.

If the value of the purchased product exceeds the gift card value, the remaining amount must be paid by the customer.

If the value of the purchased product is lower than the gift card value, the remaining balance will not be refunded and cannot be exchanged for cash.

Gift cards:

• cannot be exchanged for cash;

• cannot be used outside www.erdashoes.com;

• cannot be returned.

If a product purchased fully or partially using a gift card is returned, the amount paid using the gift card will be refunded in the form of a new gift card, according to the applicable conditions.

These characteristics do not affect the functionality of the product and are communicated to the customer before completing the purchase.

By purchasing an ERDA Outlet / Second Choice product, the customer confirms that they have reviewed and understood the specific characteristics of the product and accepts the purchase under the conditions presented.

Aesthetic particularities or differences that were clearly communicated before purchase cannot subsequently be considered defects or product non-conformities.

Products from the ERDA Outlet / Second Choice category remain subject to applicable consumer protection rights, including legal rights related to product conformity, where the issue differs from the characteristics previously disclosed.

17. Shipping and Delivery

ERDA makes reasonable efforts to process orders as quickly as possible.

Orders are generally processed and handed over to the courier service within a maximum of 3 business days after order confirmation, except in situations beyond ERDA’s reasonable control.

Delivery times may vary depending on:

• product availability;

• seasonal periods;

• delivery destination;

• courier activity;

• force majeure events.

Customers are responsible for providing complete and accurate delivery information.

ERDA cannot be held responsible for delays or additional costs caused by incorrect or incomplete delivery information provided by the customer.

Products are checked and properly packaged before shipment.

Customers are encouraged to check the condition of the package upon delivery and notify ERDA in case of visible damage to the package.

18. Right of Withdrawal and Product Returns

Consumers benefit from the legal right of withdrawal from distance contracts, according to applicable consumer protection legislation.

Customers may request the return of products within 14 calendar days from the date of receiving the products, without being required to provide a reason.

To exercise the right of withdrawal, customers must submit a return request using the return form available on the website or through the contact methods provided by ERDA.

Returned products must be:

• in the same condition as received;

• unworn;

• free from signs of use beyond normal inspection;

• undamaged;

• returned together with any included accessories and packaging, where applicable.

ERDA may postpone the refund until receiving the returned product or until the customer provides proof of shipment, whichever occurs first.

19. Product Exchanges

Depending on product availability and the specific circumstances, ERDA may offer customers the possibility to exchange a product for another product or another size.

Product exchange is a commercial facility offered by ERDA and does not limit the consumer’s legal right of withdrawal.

If the customer requests another product or size and an exchange cannot be completed, the customer may use the return procedure and place a new order.

ERDA cannot guarantee availability of a specific model, color, or size for exchange.

20. Packaging Costs

ERDA products are delivered in appropriate packaging designed to protect the product during transport.

When returning a product, customers must take reasonable care to protect the original packaging.

If the original packaging is damaged to such an extent that it can no longer be reused for product resale, ERDA may request reimbursement of the reasonable replacement cost.

The standard replacement cost of the original packaging is 10 RON.

This amount may only be charged where the packaging damage exceeds normal handling required to inspect the product.

21. Product Warranty and Legal Conformity

Products sold by ERDA benefit from statutory consumer rights regarding product conformity, according to applicable legislation.

ERDA is responsible for non-conformities existing at the time of delivery under the conditions provided by law.

The following are not considered manufacturing defects:

• washing methods not recommended by ERDA;

• exposure to inappropriate conditions;

• normal wear and tear;

• accidental mechanical damage;
